44 year old Daniel Allen, a resident of the Clinton Township area in Detroit will stand trial for biting his neighbor, 28 year old Winifred Fernandez during a scuffle after a football landed in his front yard.
Allen who is gay and confirmed to the local Fox News affiliate that he is HIV-Positive has been charged with "using HIV as a weapon" with the intent to maim, assault with intent to commit great bodily harm and possession of a harmful device.
Police say Allen bit him through the lip, on the ear, nose and neck. Fernandis was hospitalized after the attack.
"He didn't throw one punch at me. He grabbed up and the first thing he did was bit me and scratched me. It seemed like he was aiming towards something", says Fernandis who was unaware of Allen's status and was informed on camera by Fox News.
While Fernandis claims to be the victim in this unfortunate incident Allen is telling a different story. "The hostility towards me is because it's a hate crime because of my sexuality", says Allen who tells Fox news he acted in self defense and also provides photos of his injuries. Fernadnis denies the accusation of a hate crime based on his profession; "That cannot possibly be-I'm a cosmetologist. I deal with gays all the time".
This one has rendered me speechless. In 2009 people are still unaware of how HIV is transmitted? What are the odds that Fernandis was infected through this incident? *smh*

Well one thing it is not doing is educating people on the transmission of HIV. I have to smh too and keep it pushing.

I have sooooo many comments about that news report, but I won’t even go there..
I won’t talk about the Al Sharpton perm
I won’t talk about the embarrassing claim of “Hate Crime” being thrown out there, ESPECIALLY when ole’ dude looked just as sweet as Big Perm.
I’m still in shock that all of this started over a football. Learning that cosmetologists play contact sports is very intriguing to me.
And finally, I will not talk about the claim supposedly his “sexual-alley” was the motive in behind the whole thing.
I guess there’s nothing for me to talk about then.

I don't know what the gun laws are in Detroit but (assuming he was being threatened) he might have been better off if he had just pulled a gun on dude and shot him.
That's another thing, know the gun laws in your state, city or jurisdiction. If you live in an all-black contruct, you might have predatory and/or agressively homophobic neighbors and a firearm may come in handy.

So this is what detroit gives? I guess I was right to never go there. I hear such madness coming from that city, and I refuse to visit.
It's a shame that after all we know about the disease, the media and people are still so uneducated about it.

To me this is not about how the disease is transmitted. It is the fact that he BIT him KNOWING he could possibly pass it on. He SHOULD be arrested with intent to kill (regardless of HIV now being manageable it is still a killer). The human mouth is full of germs...Tetanus can be spread through biting.
Being bitten is worse than being spat upon, in my opinion.
Oh and that perm is NOT the bizness.
